By The City Council Of The City Of Sulphur Springs, Texas, Approving A Project Plan And Financing Plan For City Of Sulphur Springs Tax Increment Financing Reinvestment Zone Number One; And Providing An Effective Date.
Whereas, this City Council of the City of Sulphur Springs, Texas, has created City of Sulphur Springs Tax Incremental Financing Reinvestment Zone Number One (the “Zone”) and has established a Board of Directors for the Zone;
Whereas, a Preliminary Project and Financing Plan (the “Preliminary Financing Plan”) was prepared for the Zone and presented to each of the taxing units that levies taxes on real property in the Zone;
Whereas, the Board of Directors has adopted a project plan and a reinvestment zone financing plan (the “Project and Financing Plan”) for the Zone; and
Whereas, this City Council has reviewed the Project and Financing Plan and has found and determined that the Project and Financing Plan are feasible and conform to the master plan of the City, and that the projects set forth in the Plan will promote the development and redevelopment of the Zone: now, therefore
Be It Ordained By The City Council Of The City Of Sulphur Springs:
Section 1. The City Council finds that all matters stated in the preamble of this Ordinance are true and correct and are hereby incorporated into the body of this ordinance.
Section 2. The Project and Financing Plan (attached hereto as Exhibit A) in the form and substance attached hereto and incorporated herein, are hereby approved.
Section 3. This ordinance is effective on the date of final passage by the City Council of the City.

THE CITY COUNCIL OF THE CITY OF SULPHUR SPRINGS, TEXAS, PROVIDING FOR THE ISSUANCE OF CITY OF SULPHUR SPRINGS, TEXAS GENERAL OBLIGATION REFUNDING BONDS, SERIES 2009, TO SECURE FUNDS FOR THE PURPOSE OF REFUNDING A PORTION OF THE CITY’S OUTSTANDING BONDS AND CERTIFICATES OF OBLIGATION; DELEGATING TO AN OFFICER OF THE CITY THE AUTHORITY TO EFFECT THE SALE OF REQUIREMENTS SET FORTH IN THIS ORDINANCE; PRESCRIBING THE FORM OF THE BONDS; LEVYING AD VALOREM TAXES FOR THE PAYMENT OF PRINCIPAL AND INTEREST ON THE BONDS; MAKING CERTAIN OTHER COVENANTS OF THE CITY IN REFERENCE TO THE BONDS AND THE FUNDS FROM WHICH SAID BONDS ARE TO BE PAID; APPROVING AN OFFICIAL STATEMENT; PROVIDING AN EFFECTIVE DATE; AND ENACTING OTHER PROVISIONS RELATING THERETO.

NOTICE OF INTENTION TO ISSUE
COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION
The City of Sulphur Springs does hereby give notice of intention to issue Combination Tax and Revenue Certificates of Obligation, in one or more series, in the maximum principal amount not to exceed $4,410,000 for paying all or a portion of the City’s contractual obligations incurred in connection with (i) constructing and reconstructing streets and sidewalks, improving, acquiring and installing park improvements, public access areas and public parking facilities, and constructing and equipping the Main Street Market, for the downtown revitalization project, including related drainage, utility infrastructure, landscaping, lighting and signage for said projects, and the acquistion of land and interests in land and properties therefor; (ii) acquiring, constructing, installing and equipping additions, extensions and improvements to the City’s waterworks and sewer department, parks department, fire department and police department; and (iv) for paying legal, fiscal and engineering fees in connection with such projects. The City proposes to provide for the payment of such Certificates of Obligation from the levy and collection of ad valorem taxes in the City as provided by law, and from a limited pledge of the surplus revenues of the City’s waterworks and sewer system, remaining after payment of all operation and maintenance expenses thereof, and all debt service, reserve, and other requirements in connection with all of the City’s revenue bonds or other obligations (now or hereafter outstanding), which are payable from all or any part of the Net Revenues of the City’s waterworks and sewer system. The City Council tentatively proposes to adopt on first reading at a meeting to be held at 7:00 P.M. on June 2, 2009, and on second and final reading at a meeting to be held at 7:00 P.M. on June 23, 2009, an ordinance authorizing the issuance of City of Sulphur Springs, Texas Combination Tax and Revenue Certificates of Obligation, at the City Hall, 125 South Davis, Sulphur Springs, Texas 75482.

REQUEST FOR PROPOSALS
FOR CONSTRUCTION MANAGER-AT-RISK

Sealed proposals will be received by Supt. Patsy Bolton, Sulphur Spirngs Independent School District, 631 Connally Street, Sulphur Springs, TX 75482, and shall be received until 2:00 p.m. (CST), 6-1-2009, at the above address, to provide Construction Management at-Risk services for the 2009 Bond Issue projects consisting of a New Middle School, a New Multi-purpose facility, Additions to the Soccer Field and Practice Track, Addition/renovation to the existing Douglas Intermediate campus and addition/Renovations to the exiting Middle School campus. A total of Ten (10) copies of all submitted material are requested. The proposals will be opened at that time – 2:00 p.m. (CST), 6-1-09.
The successful firm will be required to enter into an Owner/Construction Manager Agreement, AIA Document A121/CMc-AGC Document 565, 1991 Edition as modified by Supplementary Conditions to the Standard Form of Agreement between Owner and Construction Manager with the Sulphur Springs Independent School district and to furnish Performance and Payment bonds through an approved bonding company duly authorized to do business in the State of Texas and currently listed in the Department of Treasury Federal Register in an amount of not less than 100% of the contract price, conditioned upon the performance of the contract.
Attention is called to the fact that the construction Manager must comply with all Federal, State and local labor laws, including Chapter 2258, Texas Government Code, Title 10, and the prevailing minimum wage rates as set by the Sulphur Springs ISD Board of Trustees.
All parties acknowledge the right of the Owner to reject any or all of the Proposals and to waive any informality or irregularity in any Proposal received. By submitting a Proposal, each Bidder agrees to waive any claim it has or may have against the Owner, the Architect/Engineer and their respective employees arising out of or in connection with the administration, evaluation or recommendation of any Proposal.
Pursuant to the provisions of the Texas education Code Section 44.038, it is the intent of the Sulphur Springs ISD to select a Construction Manager-at-Risk via a TWO STEP PROCESS. The Owner shall use the following criteria for selection of a Construction Manager: reputation of vendor, past relationship with the District, experience with similar projects, price to District for services, safety record (including number of citations by OSHA, lawsuits due to safety violations), references from past jobs, change orders, history of past jobs, timely completion of past jobs, proposed personnel and financial stability.

The Sulphur Springs Independent School District is currently accepting bids for Milk, Bread, Ice Cream, Non-Carbonated Beverages, and Produce for use in their Child Nutrition Programs from August 1, 2009 through July 31, 2010. ORDINANCE NO. 2560
An Ordinance Amending Chapter 20A Of The Code Of Ordinances Of The City Of Sulphur Springs, Texas By Establishing Signage Limitations Advertising Or Promoting Sexually Oriented Businesses; Repealing All Conflicting Ordinances; Providing For A Severability Clause; Providing An Effective Date; And Providing For Publication.
Whereas, in order to promote the health, safety, morals and welfare of the citizens of the City of Sulphur Springs, Texas, and to protect the rights of adult citizens to have reasonable access to sexually oriented materials protected by the First Amendment, and to protect and provide for access by the distributors and exhibitors of sexually oriented entertainment to their intended market, it is necessary to provide reasonable provisions for the placement of signs advertising sexually oriented businesses; and
Whereas, it is important that regulations be uniform so that citizens may know where to expect to see such materials and advertisers and purveyors of sexually oriented businesses may know where such advertising activities are permitted;
Now Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SULPHUR SPRINGS, HOPKINS COUNTY, TEXAS:
That from and after the effective date of this ordinance, Section 20A-5(c) and (d) of the Code of Ordinances, City of Sulphur Springs, Texas is hereby amended to provide as follows:
c) Each sexually oriented business shall comply with all of the City’s sign and advertising requirements. Signs, circulars, handbills, or any form of advertising shall not indicate, suggest or depict, either by sight or sound, any sexual activity or specified anatomical areas.
d) No sign advertising or promoting a sexually oriented business may be placed or erected within the City of Sulphur Springs unless such sign is located in an area within which a sexually oriented business could be located pursuant to Section 20A-5(b) above, except that a sign which otherwise complies with the City’s sign requirement may be placed or erected at the location, or adjacent to the location, of an existing licensed sexually oriented business.
That all ordinances, orders or resolutions heretofore, passed and adopted by the City Council of the City of Sulphur Springs, Texas are hereby repealed to the extent that said ordinances, orders or resolutions, or parts thereof, are in conflict herewith.
If any section, subsection, clause, phrase or provision of this Ordinance is for any reason held unconstitutional or void by a court of competent jurisdiction, such holding shall not affect any valid provision of this or any orther ordinance of the City of Sulphur Springs, Texas.
This Ordinance shall take effect and be in full force thirty (30) days from and after the passage, approval and publication.
Only the descriptive caption of this Ordinance shall be published once as provided by the Revised Civil Statutes of the State of Texas.

The Hopkins County Commissioners Court will accept sealed bids until 10:00 AM , Thursday, June 18, 2009 in the County Judge’s office for the Purchase of Gasoline and Diesel Fuel for Hopkins County.
