TO THE RESIDENT QUALIFIED VOTERS OF SULPHUR SPRINGS INDEPENDENT SCHOOL DISTRICT:

NOTICE IS HEREBY GIVEN THAT an election will be held within Sulphur Springs Independent School District, on Saturday, May 9, 2009, as ordered by the Board of Trustees of Sulphur Springs Independent School District, a substantial copy of which order is printed below:

ORDER CALLING A BOND ELECTION

THE STATE OF TEXAS

COUNTY OF HOPKINS

SULPHUR SPRINGS INDEPENDENT        SCHOOL DISTRICT

WHEREAS, the Board of Trustees of Sulphur Springs Independent School District (the “District”) deems it advisable to call the election hereinafter ordered; and

WHEREAS, it is hereby officially dound and determined that holding said election on the date hereinafter set forth is in the public interest; and that the meeting at which this Order was adopted was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by the Texas Government Code, Chapter 551.

THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF SULPHUR SPRINGS INDEPENDENT SCHOOL DISTRICT:

1. The statements contained in the preamble of this Order are true and correct and adopted as findings of fact and operative provisions hereof. An election shall be held between the hours of 7:00 AM and 7:00 PM on May 9, 2009, in the District at the following designated polling place: Sulphur Springs Independent School District Administration Building, 631 Connally Street, Sulphur Springs, Texas 75482

The District shall constitute a single election precinct for the election, and the following election officers are hereby appointed to hold the election:

Alternate Presiding Judge:

Cecile Bagwell

2. The Presiding Judge shall appoint not less that two qualified election clerks to serve and assist in conducting the election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks.

3. That early voting shall be conducted by personal appearance at:

City Hall, 125 South Davis Street, Sulphur Springs, Texas 75482 and during the followiing dates and times:

Monday, April 27  8:00 am to 5:00 pm

Tuesday, April 28 7:00 am to 7:00 pm

Wed., April 29     8:00 am to 5:00 pm

Thurs., April 30   7:00 am to 7:00 pm

Friday, May 1      8:00 am to 5:00 pm

Monday, May 4    8:00 am to 5:00 pm

Tuesday, May 5    8:00 am to 5:00 pm

The early voting clerk shall keep the early voting place open during such hours for early voting by personal appearence. The early voting clerk for the election shall be Gale Roberts.

Applications for early voting by mail shall be delivered to the Early Voting Clerk, no earlier than March 10, 2009, and no later than the close of business on May 1, 2009, at the following address:

4. An early ballot board is hereby created to process early voting results, and Patty Morgan is hereby appointed as the presiding judge of said board. The presiding judge shall appoint at least two other members of the board.

5. All resident, qualified electors of the District shall be entitled to vote at the election.

6. A substantial copy of this Order shall serve as proper Notice of the election, and the President of the Board of Trustees shall cause the Notice to be published one time, not earlier than the 30th day or later that the 10th day prior to the date set for the election, in a newspaper published in the District or, if none is published in the District, in a newspaper of general circulation in the District. In addition, not later than the 21st day prior to the date set for the election, the President of the Board of Trustees shall cause the Notice to be posted on the bulletin board used for posting notices of meetings of the Board of Trustees.

7. At the election the following PROPOSITION shall be submitted in accordance with law:

PROPOSITION

Shall the Board of Trustees of Sulphur Springs Independent School District be authorized  to issue the bonds of the District, in one or more series, in an aggregate principal amount not to exceed $48,400,000, for the purpose of the construction, renovation, acquisition and equipment of school buildings in the District, and the acquisition of land necessary therefor, with said bonds to mature, bear interest, and be issued and sold in accordance with law at the time of issuance; and shall the Board of Trustees be authorized to levy and pledge, and cause to be assessed and collected, annual ad valorem taxes, on all taxable property in the District, sufficient, without limit as to rate or amount, to pay the principal of and interest on said bonds?

8. The official ballots for the election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote “FOR” or “AGAINST” the aforesaid PROPOSITIONS with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITIONS to be expressed substantially as follows:

THE ISSUANCE OF NOT TO EXCEED $48,400,000 OF BONDS BY SULPHUR SPRINGS INDEPENDENT SCHOOL DISTRICT FOR THE CONSTRUCTION, RENOVATION, ACQUISITION AND EQUIPMENT OF SCHOOL BUILDINGS, AND THE LEVYING OF THE TAX IN PAYMENT THEREOF.

9. In all respects, the election shall be conducted in accorance with the Texas Election Code. Pursuant to the federal Help America Vote Act and the Texas Election Code, each polling place shall be provided at least one voting system equipped for individuals with disabilities.

AVISO DE ELECCION DE BONOS

A LOS VOTANTES CALIFICADOS RESIDENTES DEL DISTRITO ESCOLAR INDEPENDIENTE DE SULPHUR SPRINGS:

POR MEDIO DEL PRESENTE SE SE INFORMA QUE se llevara a caabo una eleccion en el Distrito Escolar Independiente de Sulphur Springs el sabado 9 de mayo de 2009, de acuerdo a lo ordenado por la Junta de Sindicos del Distrito Escolar Independiente de Sulphur Springs, y una copia substancial de dicha orden se incluye a continuacion:

ORDEN PARA CONVOCAR UNA ELECCION DE BONOS

EL ESTADO DE TEXAS

CONDADO DE HOPKINS

DISTRITO ESCOLAR

INDEPENDIENTE

DE SULPHUR SPRINGS

EN VISTA DE QUE la Junta de Sindicos del Distrito Escolar Independiente de Sulphur Springs (en lo sucesivo, el “Distrito”) considera aconsejable convocar una eleccion que se ordena de aqui en adelante; y

EN VISTA DE QUE, por medio del presente, se determina oficialmente que la celebracion de dicha eleccion en la fecha establecida en el presente es de interes publico; y que la asamblea en la cual se adopto esta Orden estuvo abierta al publico y se dio aviso al publico de la hora, el lugar y el proposito de dicha asamblea, seguin lo que exige el Codigo de Gobierno de Texas, Capitulo 551.

POR LO TANTO, LA JUNTA DE SINDICOS DEL DISTRITO ESCOLAR INDEPENDIENTE DE SULPHUR SPRINGS ORDENA:

1. Las declaraciones contenidas en el preambulo de esta Orden son verdaderas y correctas y se adoptan como determinaciones de hechos y como disposiciones operativas del presente. Se celebrara una eleccion el 9 de mayo de 2009 de 7:00 a.m. a 7:00 p.m. en el Distrito en el siguiente lugar de votacion designado:

School District

Administration Building

631 Connally Street

Sulphur Springs, Texas 75482

El Distrito constituira un solo precinto electoral para la eleccion y por medio del presente se designa a los siguientes oficiales de la eleccion para celebrar dicha eleccion:

Juez Presidente:

Juez Presidente alterno:

Cecile Bagwell

2. El Juez Presidente designara a por lo menos dos oficiales calificados para la eleccion para servir y asistir en la celebracion de la eleccion; siempre que, si el Juez Presidente sirve como se espere, el Juez Presidente Alterno sera uno de dichos oficiales.

3. Que la votacion anticipada se llevara a cabo en personal en:

y durante el periodo de la votacion anticipada exigido o permitido por la ley, el cual es del 27 de abril al 5 de mayo de 2009, en las siguientes fechas y horarios:

Lunes 27 de abril   8:00 a.m. a 5:00 p.m.

Martes 28 de abril  7:00 a.m. a 7:00 p.m.

Miercoles 29 de abril 8:00 a.m. a 5:00 p.m.

Jueves 30 de abril  7:00 a.m. a 7:00 p.m.

Viernes 1 de mayo 8:00 a.m. a 5:00 p.m.

Lunes 4 de mayo   8:00 a.m. a 5:00 p.m.

Martes 5 de mayo  8:00 a.m. a 5:00 p.m.

El oficial de votacion anticipada mantendra abierto el lugar de votacion anticipada durante dichos horarios para la votacion anticipada en persona. El oficial de votacion anticipada para la eleccion sera Gale Roberts.

Las solicitudes de votacion anticipada por correo se deberan entregar al Oficial de votacion anticipada a partir del 10 de marzo de 2009 y a mas tardar al cierre de oficinas del 1 de mayo de 2009, en la siguiente direccion:

4. Por medio del presente se crea un consejo de boletas de votacion anticipada para procesar los resultados de la votacion anticipada y, por medio del presente, se designa a Patty Morgan como juez presidente de dicho consejo. El juez presidente designara a por lo menos otros dos miembros del consejo.

5. Todos los electores calificados que residen en el Distrito tendran derecho a votar en la eleccion.

6. Una copia substancial de esta Orden servira como Aviso adecuado de la eleccion y el Presidente de la Junta de Sindicos dara el Aviso Mediante la publicacion, una sola vez, a partir del trigesimo dia y a mas tardar el decimo dia anteriores a la fecha establecida para la eleccion, en un periodico publicado en el Dristrito o, si no hay ninguno que se publique en el Distrito, en un periodico de circulacion general en el Distrito. Adicionalmente, a mas tardar el vigesimo primer dia antes de la fecha establecida para la eleccion, el Presidente de la Junta de Sindicos se encargara de que se coloque el Aviso en el tablero de boletines que se utiliza para publicar avisos de asambleas de la Junta de Sindicos.

7. En la eleccion se presentara la siguiente PROPOSICION en conformidad con la ley:

PROPOSICION

Se debera autorizar a la Junta se Sindicos del Distrito Escolar Independiente de Sulphur Springs para emitir los bonos del Distrito, en una o mas series, en la cantidad capital agregada de $48,400,000, con el proposito de construir, renovar, adquirir y equipar los edificios escolares en el Distrito, y comprar los sitios necesarios para esto, y dichos bonos maduraran, devengaran intereses y se emitiran y venderan en conformidad con la ley al momento de su emision; y se debera authrizar a Junta de Sindicos para imponer y comprometer, hacer que se determinen y recauden, impuestos anuales de valor agregado a toda propiedad gravable en el Distrito, suficientes, sin limite de la tasa o cantidad, para pagar el capital y el interes de dichos bonos?

8. Las boletas oficiales para la eleccion se prepararan en conformidad con el Codigo Electoral de Texas de manera que se permita a los electores votar “A FAVOR” o “EN CONTRA” de la PROPOSICION antedicha, y de manera que contengan dichas disposiciones, marcas y lenguaje de acuerdo a como lo exige la ley, y con dicha PROPOSICION expresada substancialmente de la manera siguiene:

LA EMISION DE BONOS QUE NO EXCEDA DE $48,400,000 POR EL DISTRITO ESCOLAR INDEPENDIENTE DE SULPHUR SPRINGS PARA LA CONSTRUCCION, RENOVACION, ADQUISICION Y EQUIPAMIENTO DE EDIFICIOS ESCOLARES Y LA IMPOSICION DEL IMPUESTO PARA EL PAGO DE LOS MISMOS.

9. En todo lo que respecta, la eleccion se llevara a cabo en conformidad con el Codigo Electoral de Texas. En conformidad con la Ley Federal Ayuda a America a Votar y el Codigo Electoral de Texas, cada lugar de votacion dispondra de por lo menos un sistema de votacion equipado para
