An Ordinance Amending The Zoning Ordinance Of The City Of Sulphur Springs, Texas By Declaring A Certain Tract Of Land From Single Family 6,000 To Professional Office.
Whereas, the City of Sulphur Springs Planning and Zoning Commission has initiated a rezoning of property located at 1411, 1415, 1419, and 1423 Church Street, described as Lots 1, 2, 3, and 4 of Block 411, from Single Family 6,000 (SF-6) to Professional Office (PO).
Whereas, the boundaries of the new district are delineated on the City of Sulphur Springs map which is designated as the “Zoning District Map” together with all notations, references, and information is hereby adopted and made a part of this ordinance as though the same were adopted full herein.
Now Therefore Be It Ordained by the City Council of the City of Sulphur Springs, Texas, that the above tract of land be changed to Professional Office (PO) from Single Family 6,000 (SF-6).

ORDINANCE NO. 2554
An Ordinance Of The City Of Sulphur Springs, Texas Establishing A Low And Moderate Income Housing Program, Defining Eligibility And Imposing Conditions Upon The Grant Of City Owned Vacant Lots For Low And Moderate Housing Development;
Whereas, the City of Sulphur Springs, Texas has a need for the development of safe and wholesome housing for persons of low and moderate incomes and has, available therefore, an inventory of City owned vacant lots suitable for the development of such housing; and
Whereas, Section 253.010 of the Texas Local Government Code provides that the City of Sulphur Springs, Texas may sell any land owned by it to:
(A) A non-profit organization that develops housing for low income individuals and families as a primary activity to promote community based revitalization of the muncipality; or
(B) A non-profit corporation described by 26 U.S.C. Section 501(c)(3) that:
(1) Has been incorporated in this state for at least one year;
(2) Has a corporate purpose to develop affordable housing that is stated in its articles of incorporation, by-laws, or charter;
(3) Has at least 1/4 of its board of directors residing in the municipality; and
(4) Engages primarily in the building, repair, rental, or sale of housing for low income individuals and families; or
(C) A religious organization that:
(1) Owns other property located in the municipality that is exempt from taxation under Texas Tax Code Section 11.20;
(2) Has entered into a written agreement with the municipality regarding the revitalization of the land; and
Whereas, the health, safety and welfare of the citizens of the City of Sulpur Springs will be positively affected by the development of such housing, removing vacant lots, redeveloping neighborhoods, and return property to the tax rolls:
Now Therefore Be It Ordained By The City Council Of The City Of Sulphur Springs, Texas:
That Chapter 17, Article VI, Section 17-201 - 17-209 of the Code of Ordinances of the City of Sulphur Springs, shall provide as follows:
Sec. 17-201. Low and Moderate Income Housing Program Established.
There is hereby established a low and moderate income housing program in the City of Sulphur Springs, Texas.
Sec. 17-202. Qualifying Persons.
Persons whose annual income falls at or below the median income of families in the City of Sulphur Springs, Texas generally may apply for real property grants through a Qualifying Foundation and shall be qualified to receive real property to be used as their principal personal residence in accordance with the condtions imposed in this Ordinance.
Sec. 17-203. Qualifying Foundations A Qualifying Foundation shall mean any Foundation or Association that meets the requirements of Section 253.010 of the Texas Local Government Code.
Sec. 17-204. Certification.
The Qualifying Foundation shall, in each instance, certify that each applicant meets the requirements of a low to moderate income person.
Sec. 17-205. Conditional Transfer of Property to Develop Low to Moderate Income Housing.
The City may, pursuant to this Ordinance, transfer title from its regularly posted inventory of vacant building lots to the Qualifying Foundation. Each property transferred shall be conditioned upon the completion of a single family dwelling unit upon the property within five (5) years from the date of transfer. If no single family dwelling unit is completed upon any vacant lot transferred hereby within said five-year period, the conveying document will provide that the vacant lot reverts to ownership by the City.
In the event that, in order to secure development financing for the contruction of a low to moderate income home on any vacant lot transferred hereby, the Qualifying Foundation is required to convey title or an interest in the affected vacant lot before the completion of construction of a single family dwelling thereupon, then any such conveyance or interest therein shall be specifically conditioned so that the vacant lot reverts to ownership by the City if no residence as required above is completed within five (5) years of the date of the initial conveyance.
Sec. 17-206. Final Conveyance.
Upon completion of each single family residence constructed upon any vacant lot conveyed pursuant to this Ordinance, the Qualifying Foundation shall cause the lot to be transferred to a person qualified as a low to moderate income person above as his or her residence.
Sec. 17-207. Repealing Clause.
All ordinances or parts of ordinances inconsistent with the terms of this Ordinance are hereby repealed; provided however that such repeal shall be only to the extent of such inconsistency and in all other respects the Ordinance shall be cumulative or other ordinances regulating and governing the subject matter covered by this Ordinance.
Sec. 17-208. Severability Clause.
If any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of persons or circumstances, should be for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this Ordinance are declared to the severable.
Sec. 17-209. Effective Date.
This Ordinance shall take effect from and after its passage by the Sulphur Springs City Council and publication.

Sealed proposals for the construction of airport improvements at the Sulphur Springs Municipal Airport need to be addressed and delivered to Gale Roberts, City Secretary, City Hall, 125 S. Davis, Sulphur Springs, Texas 75482. Proposals will be received until 2:00 p.m. on April 9, 2009, then publicly opened and read. Any proposal received after closing time will be returned unopened.
In general, the Aviation Construction work consists of the reconstruction & overlay of the parallel & cross taxiways. The Project also includes drainage improvements consisting of Reinforced Concrete Box (RCB) culverts, grading, and underdrains.
Two paving alternates are provided: Alternate A consists of full depth PCC reconstruction and a PCC overlay. Alternate B consists of full depth HMAC reconstruction.
Two add alternates are included: Alternate 1 consists of a PCC overlay on the Terminal Apron. Alternate 2 consists of pipe underdrains on the runway.
