NOTICE OF BOND ELECTION

TO THE RESIDENT QUALIFIED VOTERS OF HOPKINS COUNTY, TEXAS:

NOTICE IS HEREBY GIVEN THAT an election will be held within Hopkins County, Texas, on

Tuesday, November 5, 2013, as provided in the order calling the election passed by the Commissioners

Court of Hopkins County, a substantial copy of which order is printed below:

ORDER CALLING A BOND ELECTION; PROVIDING FOR THE CONDUCT AND THE GIVING

NOTICE OF THE ELECTION; AND ENACTING OTHER PROVISIONS RELATING TO THE

SUBJECT

WHEREAS, this Commissioners Court finds and determines that it is necessary and advisable to

call and hold an election within Hopkins County, Texas, on the proposition hereinafter set forth; and

WHEREAS, it is further found and determined that the meeting at which this order was adopted

was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as

required by the Texas Government Code, Chapter 551; Now, Therefore

BE IT ORDERED BY THE COMMISSIONERS COURT OF HOPKINS COUNTY, TEXAS:

Section I. Election Ordered; Proposition.

An election shall be held in Hopkins County, Texas, on November 5, 2013, between the hours of

7:00 a.m. and 7:00 p.m., at which election the following proposition shall be submitted in accordance

with law:

PROPOSITION

Shall the Commissioners Court of Hopkins County, Texas, be authorized to issue the

bonds of said County, in one or more series or issues, in the aggregate principal amount

not to exceed $16,000,000, with the bonds of each such series or issue, respectively, to

mature serially within not to exceed 40 years from their date, and to be sold at such prices

and bear interest at such rates as shall be determined within the discretion of the

Commissioners Court, in accordance with law at the time of issuance, for the purpose of

constructing and equipping a facility for the County jail and Sheriff’s offices, and the

acquisition of land necessary therefor, and shall said Commissioners Court be authorized

to levy and cause to be assessed and collected annual ad valorem taxes in an amount

sufficient, within the limits prescribed by law, to pay the annual interest on said bonds

and provide a sinking fund to pay said bonds at maturity?

Section 2. Precincts and Polling Places.

The election precincts for said election only, and the polling place for each such precinct on

election day, are set forth in Exhibit A attached hereto, which is incorporated herein by reference and

made a part hereof for all purposes.

Section 3. Early Voting.

The Main Early Voting Polling Place, the Branch Early Voting Polling Places for conducting

early voting by personal appearance, the dates and hours for early voting by personal appearance and the

address for early voting by mail for said election are hereby designated as set forth in Exhibit A attached

hereto.

Section 4. Elcction Officers.

The persons to serve as officers to conduct said election on election day and for early voting shall

be appointed in accordance with the Texas Election Code. Debbie Shirley, Hopkins County Clerk, shall

serve as early voting clerk for the election.

Section 5. Ballots.

The official ballots for said election shall be prepared in accordance with the Texas Election Code

so as to permit the electors to vote “FOR” or “AGAINST” the aforesaid PROPOSITION, with the ballots

to contain such provisions, markings and language as required by law, and with such PROPOSITION to

be expressed substantially as follows:

Section 6. Conduct of Election.

(a) All resident qualified electors of said County shall be permitted to vote in said election.

(b) The election materials enumerated in Secs. 272.001, et seq., Y.T.C.A. Election Code,

shall be printed and furnished in both English and Spanish for usc at the polling place on election day and

for early voting.

(c) In all respects said election shall be conducted in accordance with the Texas Election

Code. Pursuant to the federal Help America Vote Act and the Texas Election Code, each polling place

shall be provided at least one voting system equipped for individuals with disabilities. Sufficient voting

equipment to accommodate the voters shall be provided for early voting and at each of the polling places

on election day.

Section 7. Notice of Election; Notice of Early Voting Schedule.

(a) Notice of said elcction shall be given by posting substantial copies of this Resolution in

both English and Spanish on the bulletin board used for posting notices of meetings of the Commissioners

Court of said County, and at three (3) other public places in said County not later than the 21st day before

election day; and substantial copies of this Resolution in both English and Spanish shall be published on

the same day in each of two (2) succcssive weeks in a newspaper of general circulation in said County,

the date of the first publication to be not more than thirty (30) or less than fourteen (14) days prior to the

date set for said election.

(b) Such notice, as posted and published, shall include and constitute a schedule stating 0)

the location of each temporary branch early voting polling place for said election, the election precincts

served by each branch polling place and the dates and hours that temporary branch voting will be

conducted and (ii) the locations, dates and hours for any extended time for early voting by personal

appearance.

Section 8. Effective Date. In accordance with the provisions of V.T.c.A., Government Code,

Section 1201.028, this Resolution shall be effective immediately upon its adoption by the Commissioners

Court.

PARA LOS RESIDENTES VOTANTES CALIFICADOS DEL CONDADO DE HOPKINS,

TEXAS:

POR MEDIO DEL PRESENTE SE INFORMA QUE se celebrara una elección en el Condado de

Hopkins, Texas, el martes 5 de noviembre de 2013, de acuerdo a lo dispuesto en la orden que convoca la

elección aceptada por el Tribunal de Comisionados del Condado de Hopkins, una copia substancial de la

cual de se incluye a continuación:

ORDEN CONVOCANDO UNA ELECCION DE BONOS; DISPONIENDO LA CONDUCCION Y EL

AVISO DE DICHA ELECCION; Y DECRETANDO OTRAS DISPOSICIONES RELATIVAS A ESTE

ASUNTO

EN VISTA DE QUE este Tribunal de Comisionados halla y determina que necesario y

aconsejable convocar y celebrar una elección dentro del Condado de Hopkins, Texas, sobre la proposición

presentada mas adelante en el presente;

EN VISTA DE QUE, por medio del presente se determina que la asamblea en la cual se adoptó

esta orden estuvo abierta al publico y que se dio aviso publico de la hora, el lugar y el propósito de dicha

asamblea, todo esto de aeuerdo a lo que exige el Capitulo 55 I del Código de Gobierno de Texas; Ahora,

por lo tanto,

POR LO TANTO, EL TRIBUNAL DE COMISIONADOS DEL CONDADO DE HOPKINS,

TEXAS ORDENA QUE:

Sección I. Elección ordenada; Proposición.

Se celebrara una elección en el Condado de Hopkins, Texas, el 5 de noviembre de 2013, en la

cual se presentara la siguiente proposición en conformidad con la ley:

PROPOSICÍON

¿Debera ser autorizado el Tribunal de Comisionados del Condado de Hopkins, Texas,

para emitir los bonos de dicha Ciudad, en una o mas series o emisiones, por la cantidad

de capital agregada que no exceda de $16,000,000, con los bonos de cada serie o emisión,

respectivamente, venciendo en serie en un plazo máximo de 40 anos a partir de sus

fechas, y siendo vendidos a tales precios y devengando interés a tales tasas según lo

determine a su discreción el Tribunal de Comisionados, de acuerdo con la ley al

momento de emisión, con eI fin de construir y equipar una instalación para la circel del

Condado y las oficinas del AIguacil, y la adquisición del terreno necesario para la misma;

y se debera autorizar al Tribunal de Comisionados para imponer y hacer determinar y

recaudar impuestos ad valorem anuales por una cantidad suficiente, dentro de los limites

prescritos por ley, para pagar los intereses anuales de dichos bonos y disponer de un

fondo de amortización para pagar dichos bonos en su vencimiento?

Sección 2. Precintos y Lugares de Votación.

Los precintos electorales para dicha elección solamente, y el lugar de votación para cada precinto

el dia de la elección, se estabIccen en el Anexo A, adjunto a este documento, el cual se incorpora

mediante referencia al presente para todos los propósitos.

Sección 3. Votación Anticipada.

El Lugar Principal de Votación Anticipada y las Sucursales de Votación Anticipada para votar

por anticipado en persona, las fechas y horarios de votación anticipada en persona y la dirección para

votar por anticipado por correo en dicha elección son por el presente designados como se establece en el

Anexo A adjunto al presente.

Sección 4. Funcionarios Electorales.

Las personas que servirim como funcionarios a cargo de la conducción de dicha elección durante

el dia de elección y durante la votación anticipada serán designadas en conformidad con el Código

Electoral de Texas. La oficial de votación anticipada de la elección será Debbie Shirley, Secretaria del

Condado de Hopkins.

Sección 5. Boletas de Votación.

Las boletas de votación oficiales de dicha elección se prepararán en conformidad con el Código

Electoral de Texas de manera que se permita a los votantes votar “A FAVOR” 0 “EN CONTRA” de la

PROPOSICIÓN antedicha, y de manera que contengan dichas disposicioncs, marcas y lenguaje de

acuerdo a como lo exige la ley, y con dicha PROPOSICÍON expresada substancialmente de la manera

Sección 6. Condueción de la Elección.

(a) Todos los electores calificados que residen en dicho Condado tendrán permitido votar en

dicha elección.

(b) El material de la Elección enumerado en las Secciones 272.001 y siguientes del Código

Electoral VT.C.A. se imprimirá y proporcionarán en ingles y én espanol para uso cn ellugar de votación

el dia de la elección y para la votación anticipada.

(c) En todo lo que respecta, dicha elección se llevara a eabo en conformidad eon el Código

Electoral de Texas. En conformidad con la Ley Federal Ayude a America a Votar y el Código Electoral

de Texas, cada lugar de votación dispondrá de por lo menos un sistema de votación equipado para

personas con diseapacidades. Se proporcionara suficiente equipo de votaeión para dar acomodo a los votantes en la votación anticipada y en cada lugar dc votación el dia de la elección.

Sección 7. Aviso de Elección; Aviso del cronograrna de votación anticipada.

(a) El aviso de dicha elección se dará mediante la colocación de copias sustanciales de esta

Resolución en Inglés y en espanol en el tablero de boletines que se utiliza para publicar avisos de

asambleas del Tribunal de Comisionados de dicho Condado, y en otros tres (3) lugares públicos de dicho

Condado, a más tardar el vigésimo primer dia antes del dia de la elección; y se publicaran copias

substanciales de esta Resolución en inglés y en espanol el mismo dia de dos (2) semanas consecutivas en

un pcriódico de circulación general de dicho Condado; la fecha de la primera publicación deberá ser a

partir de treinta (30) dias y a más tardar catorce (14) dias antes de la fecha establecida para dicha elección.

(b) Dicho aviso, de acuerdo a sn colocación y publicación, incluirá y constituira un programa

que indique (i) la ubicación de cada sucursal temporal de votación antieipada para dicha elección, los

precintos electorales a los que da servicio cada sucursal temporal de votaeión anticipada, y las fechas y

horarios de las sucursales emporales de votación anticipada, y (ii) las ubicaciones, fechas y horarios de

cualquier horario ampliado para la votación anticipada en persona.

Sección 8. Fecha de efectividad. En conformidad con las disposiciones de V.T.C.A., el Código

de Gobierno, Sección 1201.028, esta Resolución sera efectiva inmediatamente despues de su adopción

por el Tribunal de Comisionados.
