      CITY OF SULPHUR SPRINGS

ORDINANCE NO. 2677

 

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY

OF SULPHUR SPRINGS, TEXAS, BY DECLARING A CERTAIN TRACT OF

LAND FROM HEAVY COMMERCIAL TO LIGHT COMMERCIAL AND FROM PROFESSIONAL OFFICE TO LIGHT COMMERCIAL.

 

Whereas, a request has been received by Kennedy Commercial to rezone property located at 200 West Shannon Road, being further described as Lots 33, 35, and 36 of Block 212, from Heavy Commercial (HC) to Light Commercial (LC) and property located at 1317 West Avenue, being further described as Lot 34 of Block 212, from Professional Office to Light Commercial.

 

Whereas, the boundaries of the new district are delineated on the City of Sulphur Springs map which is designated as the "Zoning District Map" together with all notations, references, and information is hereby adopted and made a part of this ordinance as though the same were adopted full herein.

NOW, THEREFORE BE IT ORDAINED by the City Council of the City of Sulphur

Springs, Texas, that the above tract of land be changed to Light Commercial (LC) from Heavy Commercial (HC) and Professional Office (PO).

 

IT IS SO ORDAINED.

 

Passed and approved on the first reading this 1st day of December 2015.

Sealed bids for the FUEL FARM IMPROVEMENTS PROJECT - ELECTRICAL, to be constructed for

SULPHUR SPRINGS MUNICIPAL AIRPORT, City of Sulphur Springs, Texas, will be received by the City

of Sulphur Springs until 11 :OOam on Tuesday, December 22,2015. Sealed bids must be submitted to:

Bids received after 11 :OOam on Tuesday, December 22, 2015 will be returned unopened.

 

Sealed bids will be opened and read aloud on Tuesday, December 22, 2015 at 11:15am in the 2nd Floor

Conference Room at Sulphur Springs City Hall, located at 201 North Davis Street, Sulphur Springs, TX 75482.

 

The overall project includes, but is not limited to, removal of the existing underground fuel tanks, construction

of a new fuel tank foundation, concrete paving to the new fuel tank location, installation of the new fuel tanks,

and installation of a new self-serve fuel dispenser. This bid package will only pertain to the installation of new

electric and telecommunications service to the fuel farm.

Proposals shall be accompanied by a cashier's or certified check upon a national or state bank in an amount

not less than five percent (5%) of the total maximum bid price payable without recourse to the Owner, or a bid

bond in the same amount from a reliable surety company, as a guarantee that the Bidder will enter into a contract and execute performance and payment bonds within ten (10) days after notice of award of Contract to him. Such bid guarantee shall be made payable to CITY OF SULPHUR SPRINGS.

 

If the bid is over $50,000, the successful bidder must furnish a performance and payment bond upon the form

provided in the amount of one hundred per cent (100%) of the contract price from an approved surety

company holding a permit from the State of Texas to act as surety, or other surety or sureties acceptable to the Owner.

 

Bidders must be licensed under the terms of Texas State Law.

 

Mechanics and laborers on the project shall be paid not less than the minimum hourly rates set out in

Prevailing Wage Determination Number TX150038 (01/02/15). The awarded Contractor will be responsible

for submitting a "Statement of Intent to Pay Prevailing Wages" form to the Texas Department of Labor within 30 days of a Notice to Proceed. A copy of this form and the minimum hourly rates are bound in the contract documents.

 

It is the policy of the Department ofTransportation (DOT) that disadvantage business enterprises as defined in 49 CFR Part 26 shall have the maximum opportunity to participate in the performance of contracts

financed in whole or in part with Federal funds.

 

The proposed contract is subject to the Buy American provision under Section 9129 of the Aviation Safety

and Capacity Expansion Act of 1990. Details of such requirement are contained in the Specifications.

 

All bidders and proposers shall make good faith efforts as defined in Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation , to subcontract 0.0 percent of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically

disadvantage include women, Blacks, Hispanics, Native Americans, Asian-Pacific Americans and Asian

Indian Americans. The apparent successful bidder (proposer) will be required to submit information

Fuel Farm Improvements 010000-1 14081305 concerning the DBEs that will participate in this contract. The information will include the name and address for each DBE, a description of the work to be performed by each named firm, and the dollar value of the

contract (subcontract). If the bidder fails to achieve the contract goal as stated herein, it will be required to provide documentation demonstrating that it made good faith efforts in attempting to do so. A bid that fails to meet these requirements will be considered non-responsive.

 

The regulations and orders of the Secretary of Labor, OFCCP and FAR 152.61 require the contractor(s)

include, in invitations for bids or negotiations for contract over $10,000, the following notices:

 

(1) The proposed contract is under and subject to Executive Order 11246 of September 24, 1965, and to the Equal Opportunity Clause. The Bidder's (Proposer's) attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Construction Contract

Specifications" set forth in the Specifications.

(2) The Bidder (Proposer) must supply all the information required by the bid or proposal form.

(3) The successful bidder will be required to submit a Certification of Non-segregated Facilities

prior to award of the contract, and to notify prospective subcontractors of the requirement for such a Certification where the amount of the subcontract exceeds $10,000. Samples of the Certifications and Notice to Subcontractors appear in the Specifications.

 

(4) Women will be afforded equal opportunity in all areas of employment. However, the employment of women shall not diminish the standards or requirements for the employment of minorities.

 

For contracts of $50,000 or more, a contractor having 50 or more employees, and his subcontractors having

50 or more employees and who may be awarded a subcontract of $50,000 or more, will be required to maintain an affirmative action program within 120 days of the commencement of the contract.

 

City of Sulphur Springs reserves the right to reject any or all bids, to waive irregularities in the bids and

bidding deemed to be in the best interests of City of Sulphur Springs, and to reject nonconforming,

nonresponsive, or conditional bids.

 

Bids must remain iin effect for 60 days after the bid opening date.
