ORDINANCE NO. 2015-08-001

 

AN ORDINANCE OF THE CITY OF CUMBY, TEXAS, PROVIDING FOR

CONTROLLING OUTDOOR BURNING; PROVIDING FOR A PENALTY FOR

THE VIOLATION OF TIDS ORDINANCE; PROVIDING FOR A SAVING AND

SEVERABILITY CLAUSE; PROVIDING FOR AN EMERGENCY EFFECTIVE

DATE OF TIDS ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION HEREOF.

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

CITY OF CUMBY, TEXAS:

 

The City of Cumby, Texas adopts and incorporates into its this municipal ordinance for all purposes as if copied verbatim Title 30 (Environmental Quality), Part 1 (TCEQ), Chapter 111- (Control of Air Emissions from Visible Emissions and Particulate Matter), Subchapter B. (OUTDOOR BURNING) Rules/Sections 111.201, 111.203, 111.205, 111.207,111.209, 111.211,111.213,111.215,111.219, and 111.221.

 

SECTION 2: PENALTY PROVISION. Any person, firm, corporation or business entity violating this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine not to exceed the sum of FIVE HUNDRED DOLLARS ($500.00), unless the violation related to fire safety, zoning or public health and sanitation, including dumping and refuse, in which the fine shall not exceed the sum of TWO THOUSAND AND NOIlOO DOLLARS ($2,000.00). Each continuing day's violation under this Ordinance shall constitute a separate offense. The

penal provisions imposed under this Ordinance shall not preclude Cumby from filing suit to enjoin the violation. Cumby retains all legal rights and remedies available to it pursuant to local, state and federal law .

 

SECTION 3: SA VINGSIREPEALING CLAUSE. All provisions of any ordinance

in conflict with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending prosecution for violation of the repealed ordinance, nor shall the repeal prevent a prosecution from being commenced for any violation if occurring prior to the repeal of the ordinance. Any remaining portions of said ordinances shall remain in full force and effect.

 

SECTION 4: SEVERABILITY. Should any section, subsection, sentence, cause

or phrase of this Ordinance be declared unconstitutional or invalid by a court of

competent jurisdiction, it is expressly provided that any and all remaining portions of this Ordinance shall remain in full force and effect. Cumby hereby declares that it would have passed this Ordinance, and each section, subsection, clause or phrase thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses and

phrases be declared unconstitutional or invalid.

 

SECTION 5: DECLARING AN EMERGENCY. Whereas an emergency is apparent for the immediate preservation of order, health, safety, and general welfare of the public, all rules and regulations requiring the reading of Ordinances more than one time on more than one occasion are hereby suspended.

Media Release for Free and Reduced-Price Meals for Cumby ISD

 

Cumby ISD announced its policy today for providing free and reduced-price meals for children from households which meet current income eligibility guidelines. Each school/site or the central office has a copy of the policy, which may be reviewed by anyone on request.

 

Starting on August 17, 2015 will begin mailing letters to the households of the children in the district about eligibility benefits and any actions households need to take to apply for these benefits. Applications also are available at Cumby ISD, 303 Sayle Street, Cumby, Texas 75433 

 

Criteria for Free and Reduced-Price Meal Benefits

The following criteria will be used to determine a child’s eligibility for free or reduced-price meal benefits:

Income

1. Household income that is at or below the income eligibility levels

Categorical or Automatic Eligibility

2. Household receiving Supplemental Nutrition Assistance Program (SNAP), Temporary Assistance for Needy Families (TANF); or Food Distribution Program on Indian Reservations (FDPIR)

 

Program Participant 

3. Child’s status as a foster child, homeless, runaway, migrant, or displaced by a declared disaster 

4. Child’s enrollment in Head Start or Even Start 

 

Income Eligibility

For those households that qualify for free or reduced-price meals based on income, an adult in the household must fill out free and reduced-price meal application and return it to Shelly Slaughter,  Superintendent, Cumby ISD, 303 Sayle Street, Cumby, Texas 75433 Those individuals filling out the application will need to provide the following information:

1. Names of all household members

2. Amount, frequency, and source of current income for each household member

3. Last 4 digits of the Social Security number of the adult household member who signs the application or, if the adult does not have a social security number, check the box for “I do not have a Social Security number”

4. Signature of an adult household member attesting that the information provided is correct

 

Categorical or Program Eligibility

Cumby ISD is working with local agencies to identify all children who are categorically and program eligible. Cumby ISD will notify the households of these children that they do not need to complete an application. Any household that does not receive a letter and feels it should have should contact Shelly Slaughter, Superintendent, Cumby ISD, 303 Sayle Street, Cumby, Texas 75433.
