City easement agreement delayed again

Hopkins County Judge Chris Brown said Friday morning the easement that would allow the city construction crews to proceed with rebuilding the downtown square is still in the hands of Austin attorney Jim Allison.

Judge Brown said he and the commissioners met with Allison this week at a conference in College Station, and the attorney still has some work to do on the easement.

“We went over each point he had drawn up,” Brown said. “He is making some revisions and is supposed to have it back to us by the end of the week, and then we will be able to send it over to the city.”

Both Judge Brown and the consulting attorney indicated the agreement needs to be more specific in some areas.

One issue involves the county giving up about 30 parking spaces, at least temporarily. The city’s plans to remodel the downtown square will ultimately replace those lost parking spots and even add a few slots. The county commissioners, however, are concerned about any plans that might come up in the future and the effect on the status of the parking spaces.

The documentation currently being reviewed by Allison will be an interlocal agreement tied to the easement.

“It will just spell out, basically, that it is the county’s property and all the details that need to be spelled out,” Brown said.

“It lets [the city] construct it based on the plans that we have,” the county judge added. “We have just got to make sure everything is spelled out for the future, that if anything does ever change, that the property comes back to the county, we will be able to adjust it as we see fit if need be later down the road.”

City Manager Marc Maxwell, when asked about this latest delay Friday morning had “no comment.”
